Terms of Service

These Terms of Service ("Terms") govern your use of the BYF mobile app, web demo, and website (together, the "Service"), provided by Jonathan Stump ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

BYF is a social entertainment app for making friendly predictions and bets among people you know, using in-app virtual coins. BYF is not a gambling service and does not offer real-money wagering of any kind.

2. Virtual coins

• Coins are a virtual, in-app item with no cash value.
• Coins cannot be redeemed, withdrawn, sold, or exchanged for money, prizes, or anything of value, either through us or any third party.
• Coins cannot be transferred outside the Service, and trading them for real money is prohibited.
• Any coins or upgrades you purchase are a limited license to use a virtual item within the Service. Purchases are final except as required by law or by Apple's App Store policies.
• We may adjust, reset, or remove coin balances (for example, to fix errors, stop abuse, or at the end of a beta or demo).

3. Eligibility and accounts

You must be at least 17 years old to use the Service. You're responsible for keeping your login credentials secure and for activity under your account.

4. Acceptable use

You agree not to:

• use the Service for real-money gambling, or to arrange payments of money or anything of value tied to bet outcomes;
• harass, threaten, or abuse other users, or post unlawful or offensive content;
• interfere with, reverse engineer, or attempt to gain unauthorized access to the Service;
• create accounts by automated means or impersonate others.

5. Groups and disputes

Groups are run by their members. We aren't responsible for disagreements between members about bet outcomes, but we may remove content or accounts that violate these Terms.

6. Web demo

The web demo is provided for evaluation. Demo accounts and data may be modified or deleted at any time without notice, and purchases are not available in the demo.

7. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. On termination, any virtual coins are forfeited and have no value.

8. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, Jonathan Stump is not liable for indirect, incidental, special, or consequential damages, or for any loss of virtual items, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of $50 or the amount you paid us in the 12 months before the claim.

9. Changes

We may update these Terms. If changes are material we'll give notice in the app or on this page. Continued use after changes take effect means you accept the updated Terms.

10. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at support@byfmobileapp.com and give us 30 days to try to resolve it informally. Any dispute that isn't resolved will be brought in the state or federal courts located in Pennsylvania, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small-claims court.

11. Apple

If you downloaded the app from the App Store, these Terms are between you and us, not Apple, and Apple's standard Licensed Application End User License Agreement terms also apply.
